Terms and Conditions For Registered Participants

By accessing this website and registering for the race, we assume you accept these terms and conditions in full. Do not continue to use Ultrahalf.com if you do not accept all of the terms and conditions stated on this page.The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of India. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

  1. By registered it is understood to cover all persons who have paid the race registration fees to participate in the 10 KM and 21 KM running categories of the Woodland Ultra Half 2019 running event/tour.

  2. These terms and conditions outline the rules and regulations for participation in the Woodland Ultra Half 2019 (hereafter referred to as the 'race'), to be held on the 4th day of October, 2019.

  3. The race is a property of 4 Play Media And Communications LLP, located at: 103, Yash Apartment, Centre Point, Marris Road, Aligarh, Uttar Pradesh 202001, India.

Liability Clause

  1.  Participant is aware of the risks involved in the activities to be held under this race, and having understood the risks associated with the sport has willingly agreed to participate in the race. 4Play Media and Communication LLP and associated partners shall not be liable for any personal or material damages and accidents (which may lead to injury or death), arising as a cause of the activities, the participants are participating in during the event. 

Cancellations of Registration

  1. 4Play Media and Communication LLP reserves the right to select/confirm/cancel any participation before the actual date of the race.

  2. If in case 4Play Media and Communication LLP cancels any participation of its own accord, the seat booking amount will be refunded within a month of notification.

Videography and Photography

  1. 4Play Media and Communication LLP, its representatives and employees have complete photography and videography rights of participant's activities in connection with the race we are conducting to be known as ‘Woodland Ultra Half’ – 2019 which is going to be held on 4th October, 2019. 4Play Media and Communication LLP can copyright, use and publish the same in print and/or electronically.

  2. 4Play Media and Communication LLP may use photographs/videographs of any participant with or without their name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and web content.

  3. Any pictures, video or audio recordings during the event and any reproduction thereof is the property of 4Play Media and Communication LLP. Participants would not use any of such recording on personal or public platform without the permission of 4Play Media and Communication LLP unless otherwise agreed there between on some terms of agreement. And all posts related to ‘Woodland Ultra Half’ – 2019 on private and public social media platforms are prohibited unless the credits are given to 4Play Media and Communication LLP and associated partners.

Emergency, Evacuation, Race Cancellation

  1. In case of any medical emergency and need for medical evacuation of the registered participant from the race venue, the company will undertake all reasonable measures to ensure smooth passage and rescue of the participant. However, the company or its partners cannot be held liable for the outcome of such an evacuation or medical emergency. 

  2. The costs of a medical evacuation will be borne by the insurer, subject to claim approval.

  3. All adventure sports events are weather dependent, hence the smooth execution of the race, will be dependent on the weather at the event venue on the race day. In case the company does not deem the weather fit for holding the race; and adverse for the physiological well being of the participants, it may cancel the race without prior notice. In such a case/eventuality, the registration fees for the race will not be refunded.

  4. The event may also be cancelled with or without notice, because of extraordinary factors, beyond human control. In which case the race fees will not be refunded.

  5. In the case of an interruption as outlined in the two points above, the insurer will cover the expenses of the insured, upto the claim amount guaranteed; and subject to claim approval.

Refund and Cancellation

  1. The general refund rules for registered participants, are as outlined below:
    - 50% refund of fee if refund is applied for before July 31st, 2019.
    - 25% refund of fee if refund is applied for before August 15th, 2019.
    - No refund requests shall be entertained post August 15th, 2019.
    - Processing fee will be deducted additionally, in the first two cases.

Disqualification

  1. The company reserves the right to disqualify and pull off course, any registered participant while the race is in progress, on medical grounds. To ensure physiological safety of the participant, should it be deemed upon evaluation by the race director and first responders deployed on course that the participant is not medically fit to progress in the race. 

  2. The company may also evoke general disqualification for a registered participant, in case the registered participant fails to meet the qualification criteria (communicated in emails to the participant, before the payment of registration fees). The disqualification may also be evoked in case where a participant uses unfair means to advance while the race is in progress or where he/she may act in a manner contrary to the physical well being of other participants.

Change of Course or Venue

  1. The company may modify or change the race venue/race course with/without prior notice, in case of extraordinary circumstances or to guarantee the safety and well being of the participant during the course of the race.

  2. The registration ticket for the race, covers the following - LINK.

Travel, Boarding/Lodging and Meals

  1. The company may assist or facilitate the booking for travel upto and return from the race venue, stay at the race venue as well as provision for meals at the race venue; all of which may not be included in the race registration fees. However, the company in such a case is acting only as a facilitator, and will not be held responsible for the quality and delivery of such services and products. The full responsibility for delivery and quality of such services and products will rest with the vendor companies and individuals who own establishments and businesses to deliver the same. 

Waiver Agreement

  1. All registered participants will be required to sign a waiver form, covering all of the terms laid out above, before the date of the event. In case of non-compliance to sign such a waiver agreement, the registered participant may be disqualified from participating in race.

Adjudication

In case of any dispute arising from this agreement, the matter will be brought to adjudication in the courts of Aligarh, UP.
